| Below, we have summarised
the kind of questions we have been asked and given answers to in
the past. If you have a query, you may well find the answer to it
in this section otherwise, we will be happy to answer your specific
query either via email at enquiry@my-pic.co.uk
or by phone on 0800 1234 5678. Q-01:
What type of claims do you handle?
A: What we do is what our business name (My Personal Injury Claim
Limited) suggests; we deal with “personal injury”
claims on behalf of individuals who have suffered an accidental
injury through someone else’s fault whether it is at work,
in a road accident or in a public place such as streets, restaurants,
shops, etc.
Q-02: Do you deal with accidents which
occur outside the UK?
A: Yes, we consider each case on its own merit. Some of our panel
of lawyers have expertise in dealing with cases that occurred
in foreign places.
Q-03: Do you deal with accidents which occurred a long
time ago?
A: It depends. If you sustained the injury over 3 years ago, we
are unlikely to be able to help you UNLESS you were under 18 years
of age at the time. However, we do advise people to claim as soon
as possible after the incident.
Q-04: How do I know if I am entitled to claim?
A: Either fill out the confidential on-line form or call us on
0800 1234 5678 and we will advise you on your specific situation.
Generally speaking, if you had an accident in the last three years
and you believe you were NOT at fault, you may well have a case
to claim.
Q-05: Am I entitled to compensation?
A: If you have suffered an injury or loss of earning as a result
of your accident due to someone else’s lack of care or failure
to comply with the law then you are probably entitled to compensation.
Once we have reviewed your special circumstances, one of our personal
injury lawyers will give you a more precise explanation.
Q-06: How much will it cost me in legal fees to apply for compensation?
A: NOTHING. If we don’t believe you have a good case for
claim we will advise you as soon as possible before anyone incurs
any costs. If however we believe you have a reasonable case for
compensation, we will prepare your claim and pass it on to one
of our panel of personal injury lawyers who will claim on your
behalf at NO COST to you at all.
Q-07: Will I have to pay anything from the money I win?
A: No. You will get every penny the lawyer wins on your behalf.
Q-08: What happens if I lose my claim, do I pay anything
then?
A: No. Whatever the outcome, you pay NOTHING. There are no ifs,
buts or small prints here.
Q-09: How much am I likely to get in compensation?
A: It depends on many factors such as the severity of your injury,
degree of loss of earning, and so on. To get a general idea about
the level of compensation you are likely to get based on previous
similar cases, please see our table of compensation in How Much
Can I Get link.
Q-10: How long will it take before my case is settled?
A: This varies depending on the complexity of each case. Straight
forward cases can be settled within 6 months but more complex
ones can take anything from one year upwards.
Q-11: How do I find out about my case progress?
A: Your lawyer will keep you informed of the progress and the
likely timescales for your case to be settled.
Q-12: What happens when I win my case?
A: Your lawyer will contact you to advise of the outcome and the
amount you have been awarded. Shortly after that, you will receive
a cheque for the full amount.
Q-13: What happens if I lose my case?
A: Your lawyer will contact you to advise of the outcome, explaining
the reasons for the loss of your case.
Q-14: Who pays the lawyer’s legal fees?
A: If the claim is successful, the lawyer is paid by the party
responsible for the injury you sustained or their insurance company.
If the claim is not successful, the lawyer is compensated through
a special insurance policy the law firm will have in place.
Q-15: Who pays “My Personal Injury Claim Limited”
for their service?
A: The assigned lawyer does. We are treated as part of the lawyer’s
expense and we get paid at the same time in the same way as the
lawyer.
Q-16: How do I start the process of claiming?
A: Either fill out one of our on-line claims form or call us free
on 0800 1234 5678. Remember, all your details will be dealt with
in strict confidence at all times.
Q-17: What happens to my claim application?
A: Once you filled out our simple form, we will contact you by
phone within two working days to advise you of our decision whether
to proceed on your behalf and confirm your wish to go ahead with
the claim.
We will then select the most appropriate personal
injury lawyer an pass your claim application to him/her. Assuming
the lawyer is happy to accept our instruction on your behalf,
he/she will then contact you to explain the process they will
take to claim on your behalf and gather any additional information
they require such as medical reports and so on.
Q-18: Will I need medical examination?
A: Very likely. We or the lawyer will arrange for you to be examined
by a medical expert who will submit a medical report on your case
to the lawyer as supporting evidence for your claim.
Q-19: What if I have already been seen by my GP or the
local hospital following the accident?
A: You may still need to be seen by one of our medical experts.
However, we will also ask you for your injury report prepared
by your GP or the local hospital.
Q-20: Who pays for the medical examination?
A: Eventually, the party responsible for the accident do. But
you have nothing to worry about because this is a free service
to you.
Q-21: Will I need to meet my lawyer or the party I am
claiming against?
A: As far as possible, your lawyer will attempt to deal with your
case by phone and you may never have to meet face to face. In
some cases such as accidents at work, the lawyer may need to meet
you and visit your place of work to ascertain the circumstances
that led to the accident. In such cases, you will be advised of
what is required and you will be involved throughout the process.
As for the other party, it is highly unlikely
that you will need to meet with them unless the case goes to court.
Q-22: Will I have to appear in court?
A: In most cases, the answer is NO. The majority of cases are
settled out of court however, in exceptional and complex cases,
the claim is contested in court and you maybe asked to appear
in court to give evidence. In such cases, your lawyer will advice
you of such a possibility and help you through the process.
Q-23: What is an expert witness?
A: In the context of “personal injury”, this usually
refers to the medical expert who is instructed to examine you.
The report submitted by the medical expert is usually accepted
by all parties as sufficient evidence. However, in more complex
cases, the medical expert may be called upon to appear in court
to answer questions related to the case.
Q-24: Will my personal and medical details be treated
confidentially?
A: Absolutely! All your details will be treated in the strictest
confidence. Further, we NEVER make information about our claimants
available to any commercial organisations to use for mailing or
promotional purposes. Once your case is concluded, all your details
are archived in highly secure files.
Q-25: I know someone who suffered an injury but they are
not sure if they want to claim, what can I do to help?
A: Firstly, you must speak to them and explain what you have learnt
from our website in order to put their mind at rest. Secondly,
encourage them to either visit our website or give them our free
phone 0800 1234 5678 to call us and we will give them our honest
and unbiased opinion.
In all circumstances, you must NOT fill out
a claim on their behalf unless you have their explicit authority
or you happen to be their guardian.
Q-26: I want to know more about My Personal
Injury Claim Limited
A: We are an independent and privately owned company which works
primarily in the UK to identify those individuals who have suffered
an injury through no fault of their own and do not have easy access
to specialist lawyers. We are completely independent of the lawyers
or insurance companies we work with. We aim to provide a simple,
honest and straight forward service to claimants by advising them
on the strength of their claims and if appropriate, put them in
touch with a suitable personal injury lawyer to act on their behalf.
